Fight The Weight™ (“FTW”, “we”, “us” or “our”) provides digital educational products, personalised coaching, training programmes and related services. Because of the nature of these products and services, our refund policy differs depending on what has been purchased.
By completing a purchase through our website, you acknowledge that you have read and understood this Refund & Cancellation Policy.
1. Digital Products
Fight The Weight™ sells digital products including, but not limited to, downloadable guides, ebooks, educational resources, programmes, workbooks and other digital materials.
All digital product sales are non-refundable once the digital product has been delivered or made available to the customer.
Digital products are delivered electronically, generally by email and/or through an electronic download or access link. Once the product has been delivered or the customer has been provided with access to the product, the customer has received the purchased product and it cannot practically be returned.
For this reason, we do not offer refunds where:
- the customer has received the digital product;
- the customer has downloaded or accessed the digital product;
- the customer has received the email containing the download/access link;
- the customer has simply changed their mind after receiving the product; or
- the customer has decided that they no longer want or need the product.
Customers are responsible for ensuring that the email address supplied during checkout is correct and that they are able to receive emails and access digital files.
If you believe that you purchased a digital product but did not receive the delivery email or access link, please contact us so that we can investigate the delivery issue and resend the product where appropriate.
This policy does not exclude any rights or remedies that cannot lawfully be excluded under applicable South African consumer-protection legislation.
2. Personalised Coaching & Training Services
FTW may provide personalised services including personalised training programmes, personalised nutrition guidance, coaching, check-ins, progress monitoring, individual recommendations and access to coaching platforms or applications.
Payments for personalised coaching and training services are non-refundable once the service has commenced or the personalised service has been prepared or delivered.
Personalised coaching is different from a standard digital product because FTW allocates time and resources to setting up each individual client.
Once a client has been onboarded, this may include:
- reviewing the information supplied by the client;
- creating or preparing the client’s personalised programme;
- setting up the client’s coaching profile;
- setting up the client within the FTW coaching application;
- allocating the client to the appropriate programme;
- preparing personalised training or nutrition information;
- establishing the client’s targets;
- preparing check-in systems;
- providing access to coaching resources; and/or
- commencing communication and coaching support.
Because these services are prepared specifically for the individual client, we cannot simply reverse the service and recover the time, preparation and resources already allocated to that client.
Accordingly, no refund will be provided because a client:
- changes their mind;
- decides not to participate;
- does not use the coaching programme;
- does not complete their workouts;
- does not submit check-ins;
- does not use the coaching application;
- becomes too busy to participate;
- experiences a change in personal circumstances; or
- decides that the programme is not suitable for them after onboarding.
3. Monthly Coaching
Where a customer purchases a monthly coaching service, the service is considered to have commenced once the customer’s personalised coaching setup has begun or access to the coaching service/application has been provided.
Monthly coaching payments are non-refundable once the monthly service has commenced.
This is because monthly coaching involves personalised preparation, administration, programme access and coaching resources that are allocated specifically to the individual client.
If a client wishes to cancel their future monthly coaching, they must provide written notice before the next billing period begins, subject to any minimum-term commitment or cancellation terms applicable to the package purchased.
Cancellation of future services does not create an entitlement to a refund for a current service period that has already commenced.
4. Payment Plans
Where a programme or service is purchased using a payment plan, the payment plan represents an agreed payment arrangement for the selected programme or service.
Cancelling participation does not automatically cancel outstanding payment obligations.
For example, if a client purchases a programme for 3 × R499, the client has selected a payment arrangement for that programme. The client may not simply stop participating in the programme and assume that future instalments are automatically cancelled.
Where applicable, cancellation of a payment plan will be dealt with according to the specific terms presented to the customer at checkout.
5. Programme Non-Participation
FTW does not guarantee that a client will complete a programme or achieve a particular weight-loss result.
If a client purchases a programme but subsequently chooses not to participate, this does not constitute grounds for a refund.
Examples include:
“I didn’t have time to do the programme.”
“I didn’t use the app.”
“I didn’t complete my workouts.”
“I didn’t submit my check-ins.”
“I changed my mind.”
“I decided to start later.”
These circumstances do not constitute a failure by FTW to provide the purchased service.
6. Technical Problems
We will make reasonable efforts to assist customers who experience genuine technical problems accessing a purchased digital product or coaching service.
If you experience a problem accessing a purchase, please contact us at:
We will investigate the issue and, where reasonably possible, provide an alternative method of accessing the purchased product or service.
Technical difficulties that can reasonably be resolved by providing a replacement download, access link, login assistance or other technical support will not automatically qualify for a refund.
7. Duplicate Purchases
If you accidentally purchase the same digital product more than once, please contact us as soon as possible.
Where we can verify that the same product was purchased multiple times accidentally, FTW may, at its discretion, assist with the duplicate transaction.
This does not apply where the customer intentionally purchases different products, programmes, packages or services.
8. Incorrect Information Supplied by the Customer
Customers are responsible for providing accurate information when completing a purchase or onboarding form.
This includes, where applicable:
- name;
- email address;
- contact details;
- payment information;
- programme information;
- health and lifestyle information; and
- information required to personalise a service.
FTW will not be responsible for non-delivery caused by incorrect information supplied by the customer, although we will make reasonable efforts to assist where possible.
9. Statutory Consumer Rights
Nothing in this Refund & Cancellation Policy is intended to remove, restrict or limit any right or remedy that a consumer has under applicable South African law where such right or remedy cannot lawfully be excluded.
South Africa’s Consumer Protection Act establishes consumer rights and regulates consumer transactions, while the Electronic Communications and Transactions Act specifically regulates electronic transactions and requires certain transaction and refund information to be made available to consumers.
Where applicable legislation provides a consumer with a right to cancel, return or obtain a refund, that statutory right will take precedence over this policy.
10. Refunds for Faulty or Incorrectly Supplied Products or Services
Our “no refund” policy does not mean that FTW refuses to address legitimate problems with a product or service.
If:
- a digital product is materially defective;
- the wrong product was supplied;
- FTW materially fails to provide a purchased service; or
- another circumstance arises where applicable law gives the customer a right to a remedy,
the customer should contact FTW so that the matter can be investigated and an appropriate remedy can be determined.
South African consumer law provides protections relating to defective or poor-quality goods and services, so the website should not attempt to contract those statutory rights away.
