These Terms & Conditions (“Terms”) govern your use of the Fight The Weight™ website, digital products, coaching programmes, training programmes and related services.

By accessing this website, purchasing a product or service, registering for a programme, joining a coaching programme or otherwise using our services, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use the website or purchase our products or services.

Fight The Weight™ (“FTW”, “we”, “us”, “our”) provides educational resources, digital products, weight-management education, personalised coaching, training programmes and related support services.

  • The 13-Week Sustainable Body Transformation Programme;
  • Personalised coaching;
  • Personalised training programmes;
  • Monthly coaching services;
  • Progress check-ins;
  • Access to coaching applications/platforms;
  • WhatsApp community/support;

  • Other products or services introduced from time to time.

3. Educational Nature of Our Services

Fight The Weight™ provides weight-loss education, nutrition education, lifestyle guidance and coaching support.

FTW is not a medical practice, medical provider or emergency healthcare service.

Our content and services are intended to provide general education and coaching support and should not be interpreted as:

  • medical diagnosis;
  • medical treatment;
  • medical advice;
  • prescription of medication;
  • treatment of disease;
  • psychological treatment; or
  • a substitute for consultation with a qualified healthcare professional.

Where appropriate, clients should consult their doctor, registered dietitian, pharmacist or other appropriately qualified healthcare professional.

This is particularly important for individuals with medical conditions, diabetes, eating disorders, pregnancy, breastfeeding, medication use or other circumstances requiring professional medical supervision.


4. No Guaranteed Weight-Loss Results

FTW does not guarantee a specific amount of weight loss, body-fat reduction, physical transformation or other result.

Individual results depend on numerous factors, including:

  • starting weight;
  • body composition;
  • adherence;
  • nutrition;
  • activity levels;
  • sleep;
  • stress;
  • medical conditions;
  • medication;
  • genetics;
  • age;
  • hormonal factors;
  • lifestyle; and
  • individual circumstances.

Testimonials, photographs and examples displayed on our website or social media represent individual experiences and should not be interpreted as a guarantee of your own results.


5. Eligibility

Unless otherwise stated on a particular programme or service, FTW services are intended for adults aged 18 years or older.

By purchasing a service, you confirm that:

  • you are at least 18 years old;
  • the information you provide is accurate;
  • you are legally capable of entering into the agreement; and
  • you are purchasing the service for yourself or have authority to purchase it for another person.

FTW may refuse or terminate participation where we reasonably believe that a service is inappropriate or unsafe for an individual.


6. Digital Products

FTW sells digital products that may be delivered by email, download link, website access or another electronic method.

After payment has been successfully processed, the purchased digital product may be delivered electronically.

You are responsible for:

  • providing a correct email address;
  • ensuring that you can receive emails;
  • maintaining access to your email account;
  • downloading or saving your purchased materials; and
  • keeping your purchased materials secure.

Digital products are licensed to the purchaser for personal use only, unless otherwise stated.

You may not:

  • resell the product;
  • redistribute the product;
  • upload it to public websites;
  • share download links;
  • reproduce the product commercially;
  • claim the content as your own;
  • distribute copies to other people; or
  • use the material to create a competing commercial product.

7. Personalised Coaching Services

Some FTW services involve individualised preparation and coaching.

Depending on the service purchased, FTW may:

  • review information supplied by you;
  • establish personalised targets;
  • prepare personalised training information;
  • prepare nutrition guidance;
  • create or configure your coaching profile;
  • establish your check-in system;
  • provide access to the coaching application;
  • monitor information supplied during check-ins; and
  • provide personalised coaching support.

Because these services require individual preparation and allocation of resources, the service is not equivalent to purchasing a standard downloadable product.

Once personalised service delivery has commenced, the applicable Refund & Cancellation Policy applies.


8. Coaching Application and Third-Party Platforms

FTW may use third-party platforms and applications to deliver services.

These may include, where applicable:

  • Everfit;
  • WhatsApp;
  • email platforms;
  • payment processors;
  • website hosting platforms; and
  • other technology providers.

Use of third-party platforms may also be subject to those providers’ own terms and privacy policies.

FTW cannot guarantee uninterrupted availability of third-party platforms.

Where a platform experiences an outage or technical problem outside FTW’s reasonable control, we will make reasonable efforts to restore or provide access to the affected service.


9. WhatsApp Community and Communications

Where a programme includes a WhatsApp community or communication group, participation is subject to reasonable community standards.

Members must not:

  • harass other members;
  • bully or threaten others;
  • share another member’s private information;
  • distribute inappropriate material;
  • promote competing services without permission;
  • spam the group;
  • provide dangerous medical advice to other members; or
  • use information obtained from the group for commercial purposes.

FTW reserves the right to remove a member from a community where their conduct materially disrupts the community or creates a safety, privacy or legal concern.

Removal for misconduct does not automatically create an entitlement to a refund.


10. Programme Access

Programme access is provided for the period specified on the relevant sales page.

For example, where a programme is advertised as a 13-week programme, access is provided in accordance with the programme structure and access period communicated at the time of purchase.

Programme dates, content and delivery methods may occasionally be adjusted where reasonably necessary.

FTW will endeavour to provide reasonable notice of material changes.


11. Client Responsibilities

Clients are responsible for participating appropriately in the service they purchase.

This includes, where applicable:

  • completing onboarding information;
  • providing accurate information;
  • completing check-ins;
  • communicating relevant concerns;
  • following instructions;
  • using the coaching application;
  • attending scheduled sessions;
  • completing assigned activities; and
  • seeking appropriate medical advice where required.

FTW cannot be responsible for results where a client chooses not to participate in the programme or does not provide the information reasonably required to provide the service.


12. Accuracy of Information

You agree that information supplied to FTW will be accurate and reasonably complete.

This may include information concerning:

  • age;
  • weight;
  • height;
  • activity;
  • nutrition;
  • lifestyle;
  • medical conditions;
  • medications;
  • injuries;
  • goals; and
  • other information relevant to your coaching.

Providing inaccurate or incomplete information may affect the suitability of recommendations and services.


13. Payments

All prices displayed on the website are stated in South African Rand unless otherwise indicated.

Payment may be processed through third-party payment providers, including PayFast or other payment providers made available by FTW.

By submitting payment details, you confirm that you are authorised to use the relevant payment method.

FTW reserves the right to change prices for future purchases.

Any price applicable to an existing purchase will be determined by the terms presented at the time of purchase, subject to applicable law.


14. Payment Plans

Where a programme is offered through an instalment or payment-plan arrangement, the payment plan constitutes an agreed method of paying for the selected product or service.

Failure to participate in the programme does not automatically cancel outstanding payment obligations.

Any specific payment-plan terms presented during checkout form part of the agreement.


15. Refunds and Cancellations

Refunds and cancellations are governed by our separate:

Digital products are generally non-refundable once delivered or accessed, and personalised coaching services are generally non-refundable once onboarding, personalisation or service delivery has commenced, subject always to any rights that cannot lawfully be excluded under South African law.

Nothing in these Terms is intended to exclude statutory consumer rights that cannot legally be excluded.

South Africa’s ECTA contains specific protections relating to electronic transactions and consumer agreements, including provisions that prevent certain statutory rights from being excluded by contract.


16. Intellectual Property

All FTW content is protected by applicable intellectual-property laws.

This includes, without limitation:

  • logos;
  • branding;
  • text;
  • photographs;
  • graphics;
  • videos;
  • worksheets;
  • ebooks;
  • guides;
  • training programmes;
  • educational material;
  • programme structures;
  • presentations;
  • website content; and
  • other original materials created by or for FTW.

Purchasing a product or service does not transfer ownership of FTW intellectual property to you.

You receive a limited, non-exclusive, non-transferable licence to use purchased materials for your own personal use.


17. No Unauthorised Sharing

Clients may not share paid FTW content with friends, family members, social-media groups, public forums or other individuals who have not purchased the relevant product or service.

This includes screenshots, PDFs, videos, programme materials, app content and downloadable resources.

Unauthorised distribution may result in termination of access and/or further legal action where appropriate.


18. Website Use

You may use the FTW website for lawful purposes only.

You may not:

  • interfere with website functionality;
  • attempt to gain unauthorised access;
  • introduce malicious software;
  • scrape or copy website content for commercial purposes;
  • impersonate another person;
  • submit fraudulent information; or
  • use the website to conduct unlawful activities.

19. Third-Party Links

Our website may contain links to third-party websites, applications or services.

FTW does not control those third parties and is not responsible for their:

  • content;
  • availability;
  • security;
  • privacy practices;
  • products; or
  • services.

Your use of third-party services may be subject to separate terms.


20. Limitation of Liability

To the extent permitted by law, FTW will not be liable for losses arising from circumstances outside our reasonable control.

This may include:

  • internet outages;
  • third-party platform outages;
  • payment-provider failures;
  • device problems;
  • email delivery failures caused by third parties;
  • loss of login credentials;
  • client failure to follow instructions; or
  • inaccurate information supplied by the client.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Nothing in these Terms is intended to exclude statutory consumer rights or protections that cannot legally be excluded.


21. Indemnity

To the extent permitted by law, you agree to indemnify FTW against reasonable losses, claims or expenses arising from your:

  • unlawful use of the website;
  • unauthorised distribution of FTW materials;
  • misuse of our intellectual property;
  • breach of these Terms; or
  • fraudulent or unlawful conduct.

22. Changes to Services

FTW may modify, update or discontinue parts of the website or services where reasonably necessary.

Where a material change affects an existing paid service, FTW will endeavour to provide reasonable notice and, where required by law, an appropriate remedy.


23. Changes to These Terms

We may update these Terms from time to time.

The updated version will be published on this website with a revised “Last Updated” date.

Your continued use of the website after an updated version has been published constitutes acceptance of the updated Terms to the extent permitted by law.


24. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be subject to the applicable laws and jurisdiction of South Africa, subject to any mandatory consumer rights and dispute-resolution mechanisms provided by law.
